Item 9 Memorandum of Understanding between M-NCPPC and SilverPlace, LLC for the SilverPlace Project

SilverPlace is a public/private partnership through which the Commission seeks to replace its obsolete and overcrowded headquarters building while facilitating several public policy objectives including provision of affordable housing, smart growth, and green building. In response to a Request for Proposals seeking exemplary mixed-use development of the Montgomery Regional Office site at 8787 Georgia Avenue, development entities responded with various design concepts and financial proposals. On January 18, 2007, the Planning Board approved the ranking of proposals from three finalists. Staff has negotiated a Memorandum of Understanding (MOU) with the top ranked development team, SilverPlace, LLC, and seeks the Planning Board’s approval to execute the MOU Staff Recommendation: Approval for staff to execute the Memorandum of Understanding

In response to a Request for Proposals seeking exemplary mixed-use development of the Montgomery Regional Office site at 8787 Georgia Avenue, development teams responded with various design concepts and financial proposals.
On January 18, 2007, the Planning Board approved the ranking of proposals from three finalists. Staff has negotiated a Memorandum of Understanding with the top ranked firm, SilverPlace, LLC that sets the mutual understandings of the parties towards advancing the project. The supplemental appropriation request funds the design of the public portion of the project from its current conceptual stage through the design development (40% design) stage Staff Recommendation: Approval to transmit CIP amendment and supplemental appropriation request to County Council and County Executive

The purpose of this Public Private Partnership Policy is to provide consistent, effective and clear guidance for the consideration and implementation of private entities partnering with the Commission to develop compatible facilities on park property and/or providing a public service for park and recreation purposes with, and on behalf of the Commission to better serve the park and recreation user public. These policies were initially adopted in March 8, 1996 and amended in December 4, 2003. The draft policies are recommended to replace the currently adopted policies and will also be considered for Commission-wide adoption Staff Recommendation: Approval

and General Water/Sewer Map Amendments
