Proposed Zoning Text Amendment (ZTA), Accessory Residential Uses – Accessory Dwelling Unit (ADU) (Public Testimony Accepted)

This ZTA would amend the provisions for Accessory Dwelling Units (ADUs) to be compliance with recently adopted State legislation in House Bill 1466/Senate Bill 891.

Staff Recommendation: The Planning Board transmit a request to the District Council to introduce the ZTA.

Proposed Zoning Text Amendment (ZTA), Solar Collection System – Standards (Public Testimony Accepted) 

This ZTA amends use standards for Solar Collection Systems to streamline certain rooftop solar instillations, and partly in response to State legislation passed in 2025 with Senate Bill 931/ House Bill 1036 (Renewable Energy Certainly Act). 

Staff Recommendation: The Planning Board transmit a request to the District Council to introduce the ZTA.

Update of the Montgomery County Planning Board Regulation on Administrative Procedures for Development Review (Public Testimony Accepted)

This document updates the Administrative Procedures for Development Review, reflecting recent changes made to Chapters 22A, 50, and 59.

Staff Recommendation: The Planning Board approve the changes and transmit the document to the Council.

Proposed Zoning Text Amendment (ZTA), Notice Required – Standards (Public Testimony Accepted)

This ZTA amends the notice requirement standards pertaining to Application and Hearing notice, expanding the notice to all property owners to any within 500 feet of a pending application, and notice to all homeowners and civic associations to those registered and within one mile of a pending application.

Staff Recommendation: The Planning Board transmit a request to the District Council to introduce the ZTA.

In Response to a Forest Conservation Law Violation; Forest Conservation Plan Amendment F20241060 (previously SC2003001), Joseph and Cindy Cacace Property, 3721 Flintridge Court, Brookeville, MD 20833 (Public Hearing)

Request to abandon a net total of 0.21 acres (9,170 s.f.) of existing Category I Forest Conservation Easement and mitigate offsite in an approved forest mitigation bank at a 3:1 ratio (27,510 s.f.), create 0.02 acres (1,073 s.f.) of new Category I Forest Conservation Easement onsite and install new supplemental plantings within the existing conservation easement. Flintridge, Lot 14 Block A; AR Zone, 2.55 acres +/-, Hawlings River watershed, Olney Master Plan.

Staff recommendation: Approval with Conditions
